Welcome to Legends Warbird Rides ("we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of our website at www.LegendsT6.com (the "Site") and the booking and participation in our warbird ride services (the "Services"). By accessing or using the Site and booking a Service, you agree to be bound by these Terms. Please read them carefully.

1. Acceptance of Terms

By accessing our Site or booking a Service, you confirm that you are at least 18 years of age and capable of entering into a binding contract. If you are booking on behalf of others, you agree that you have the authority to accept these Terms on their behalf and that they also agree to be bound by these Terms.

2. Description of Services

We provide warbird ride experiences to the public, offering flights in the T-6 Texan aircraft. The details of each ride, including duration, aircraft type, and cost, are as described on the Site.

3. Booking and Payment

• Booking Process: Bookings can be made through our Site or by contacting us directly. To complete a booking, you will need to provide accurate personal information, including contact details, and potentially health information relevant to the ride.
• Payment: Full payment is required at the time of booking unless otherwise specified. We accept major credit cards, Venmo, PayPal and Zelle. All prices are in US Dollars and are subject to change without prior notice, although the price confirmed at the time of booking will be honored.
• Booking Confirmation: Your booking is not confirmed until you receive a written confirmation from us, typically via email.

4. Pricing and Fees

The prices for our Services are listed on the Site and are subject to change. The price for your booked Service will be confirmed during the booking process. Additional fees may apply for merchandise purchases.

5. Cancellation and Refund Policy

Our cancellation and refund policy is as follows:

• Cancellation by You: 
  • If you cancel 7 days or more before the scheduled ride date, you may receive a full refund of 100% of the booking price, minus any non-refundable deposits or fees.
  • If you cancel within 2 days of the scheduled ride date, your payment is non-refundable.
• Cancellation by Us: We reserve the right to cancel or reschedule a ride due to unforeseen circumstances, including but not limited to: 
  • Adverse weather conditions.
  • Mechanical issues with the aircraft.
  • Pilot unavailability.
  • Airfield closures or restrictions.
  • Events beyond our control (Force Majeure).
  • In the event of cancellation by us, you will be offered the option to reschedule your ride for a future date or receive a full refund of the booking price. We are not responsible for any additional costs you may incur as a result of our cancellation (e.g., travel or accommodation expenses).

6. Changes and Rescheduling

Requests to change or reschedule a confirmed booking are subject to availability and may be subject to administrative fees. We will do our best to accommodate your request, but we cannot guarantee that we will be able to reschedule your ride to your preferred date or time.

7. Participant Requirements and Responsibilities

• Eligibility: Participation in a warbird ride is subject to certain requirements, including age, height, weight, and health restrictions. These requirements are detailed on the Site and will be provided to you during the booking process. You must honestly and accurately disclose any information that may affect your eligibility or safety.
• Health and Medical Conditions: You must be in good health and free from any medical conditions that could be aggravated by or prevent your participation in a warbird ride. You may be required to complete a medical questionnaire and/or obtain medical clearance from a physician. We reserve the right to deny participation if we believe, in our sole discretion, that you are not medically fit to fly.
• Waiver of Liability: Prior to participating in a warbird ride, you will be required to sign a liability waiver and assumption of risk agreement. This is a legally binding document, and you should read it carefully.
• Conduct: You must follow all instructions given by the pilot and ground crew before, during, and after the flight. We reserve the right to refuse or terminate a ride if a participant's behavior is deemed unsafe or disruptive.
• Alcohol and Drugs: You must not be under the influence of alcohol or drugs at the time of your ride.

8. Safety Regulations and Waivers

Safety is our top priority. You must adhere to all safety briefings and instructions. You acknowledge that warbird rides carry inherent risks, including but not limited to those associated with aviation, high-G maneuvers, and potential mechanical issues. By participating, you voluntarily assume all risks associated with the activity.

9. Intellectual Property

The content on the Site, including text, graphics, logos, images, and software, is our property or the property of our licensors and is protected by copyright and other intellectual property laws. You may not use, reproduce, distribute, or modify any content from the Site without our express written consent.
